Terms of service

These terms are an agreement between you and Devya (“Devya”, “we”, “us”) for the use of Moving Stores. Please read them together with our privacy policy.

Moving Systems is a subsidiary of Devya Solutions, its parent company.

1. About these terms

Moving Stores is operated by Devya. These terms apply to everyone who creates an account, opens a store or works in a store’s back office (“you”, the “merchant”).

You accept these terms when you tick the consent box at signup or when you use the service. If you accept them for a business, you confirm that you are allowed to bind that business, and “you” then also means the business. You must be at least 18 years old and legally able to enter into a contract.

2. What the service is

Moving Stores is software that lets a business sell online. It gives you:

  • a storefront in Arabic and English, on our subdomain or on your own domain;

  • a back office to manage products or menus, stock, branches, orders, returns, customers, content and staff;

  • connections to payment providers, couriers and, if you use it, Moving POS.

We provide the software only. We are not the seller in your store and not a party to any sale between you and your customers. We do not buy, sell, hold, ship or deliver your goods.

3. Your account

  • Give true and complete information and keep it up to date.

  • Keep your password secret and tell us at once at hello@devya.dev if you think someone else has used your account.

  • You are responsible for everything done through your account and through the staff accounts you invite, and for the permissions you give them.

  • We may ask you to confirm your email address before your store opens for the first time.

4. Your responsibilities as a merchant

Your store is your business. You are responsible for:

  • the products and services you offer, and for having the right to sell them;

  • accurate descriptions, prices, stock, taxes and invoices, including any VAT you must charge;

  • accepting, preparing and delivering orders, and handling cancellations, returns, refunds, complaints and warranties;

  • following the laws that apply to your business and your customers, including consumer protection, e-commerce, tax, advertising and data protection laws;

  • publishing your store’s own terms, privacy, return and shipping pages, and keeping them accurate. Moving Stores gives you starting texts that you must review and adapt; they are not legal advice;

  • the content you upload: you must own it or have permission to use it.

5. Acceptable use

You must not use Moving Stores to:

  • sell goods or services that are illegal, counterfeit, stolen or dangerous, or that need a licence you do not hold;

  • mislead or defraud customers, or publish content that is unlawful, hateful or infringes someone else’s rights;

  • send spam, or collect personal data without a lawful basis;

  • upload malware, probe or break our security, or try to reach another store’s data;

  • overload the service, scrape it, or resell it without our written agreement.

6. Payments and cash on delivery

You choose how your customers pay: cash on delivery, bank transfer, or online card and wallet payments through Paymob, our payment partner.

  • Online payments are made under your own agreement with the provider. The money goes from your customer to you through the provider, never through Devya. Provider fees, payouts, chargebacks and refunds are between you and the provider.

  • Cash on delivery is collected by you or your courier. You are responsible for collecting it, reconciling it and marking orders paid, and you carry the risk of an order that is refused or not paid. Devya does not collect, hold or guarantee cash on delivery amounts.

  • Bank transfers are paid into your account. You confirm when a transfer arrives.

Devya never holds your customers’ money and is not responsible for a payment provider’s or a courier’s failure.

7. Plans, fees and billing

  • Each plan has the features and limits shown on our pricing. The Free plan costs nothing.

  • A paid plan may start with a free trial. If no invoice is paid when the trial ends, the store moves to the Free plan.

  • We invoice paid plans for each billing period. Pay each invoice by its due date in the way it states. Fees do not include taxes unless the invoice says so.

  • If an invoice stays unpaid, we may limit your store or move it to the Free plan until it is paid.

  • We tell you about a price change at least 30 days before it applies to your next billing period.

  • Fees already paid are not refunded unless the law requires it or we agree otherwise in writing.

8. Your content and your data

You keep all rights in your content (products, images, texts, logos) and in your store’s data. You allow Devya to host, copy, process and display it only as needed to run the service for you, including showing it on your storefront.

Your customers’ personal data belongs to your store. We process it on your behalf and on your instructions, as our privacy policy describes. You are responsible for having a lawful basis to collect it and for telling your customers how you use it.

9. Our rights

The software, design and brand of Moving Stores belong to Devya. While your account is open, we give you a limited, non-exclusive, non-transferable right to use the service under these terms. If you send us ideas or feedback, we may use them without any obligation to you.

10. Services from others

Payment providers, couriers, analytics and advertising tags that you add to your store, and the email provider we use are run by other companies under their own terms. We are not responsible for their services, their availability or their charges.

11. Availability and changes to the service

We work to keep Moving Stores available and secure, but we cannot promise that it will never be interrupted. Updates and maintenance can make it briefly unavailable. We may change, add or remove features. If a change takes away something important that you pay for, we tell you in advance.

12. Suspension and closing

  • You may stop using Moving Stores and ask us to close your store at any time.

  • We may suspend or close a store or an account if you seriously or repeatedly break these terms, do not pay, put customers or the service at risk, or if the law requires it. When it is reasonable, we warn you first and give you time to put things right.

  • Export what you need before a store is closed. After closing, we handle your data as our privacy policy describes.

13. Liability

As far as the law allows, Moving Stores is provided “as is”. Devya is not liable for indirect or consequential loss, lost profits, lost sales or lost data, nor for anything that happens in a sale between you and your customer, including unpaid cash on delivery orders and the acts of payment providers and couriers.

Devya’s total liability for all claims about the service is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms limits liability that the law does not allow to be limited.

You will compensate Devya for claims made against us because of your products, your sales, your content or your breach of these terms or of the law.

14. Changes to these terms

We may update these terms. The new version is published on this page with a new date at the top. If a change is significant, we tell you by email or in your back office at least 14 days before it applies. If you keep using the service after that, you accept the new terms; if you do not agree, you may close your store.

15. Governing law and disputes

[To be completed] Devya will set out here the law that governs these terms and the courts or arbitration that settle disputes about them.

Before starting any formal dispute, please write to us at hello@devya.dev so we can try to resolve it together.
